Nyja Prior-Brown, Of Counsel

Nyja Brown-Prior’s experience as a litigator spans business and commercial disputes, intellectual property, and employment law, with a particular depth in patent, trade secret, and trademark matters. Before joining Brown Wegner LLP, she spent nearly three years at Knobbe Martens, one of the nation’s leading intellectual property firms, handling complex patent infringement, trade secret misappropriation, and trademark disputes in federal courts and before the USPTO. She subsequently expanded her practice at a boutique firm, adding employment law to her litigation repertoire. Nyja is admitted to practice in California and Nevada, and is currently completing her LL.M. in Gaming Law at the University of Nevada Boyd School of Law.

Nyja earned her J.D. from the University of Florida Levin College of Law on a full tuition scholarship, graduating in the top 22% of her class. She received the Family Law Book Award and was named to the Dean’s List for two consecutive years. She externed for the Honorable Judge O’Malley of the Court of Appeals for the Federal Circuit and for the Honorable Judge Van Vorst at the Alachua County Civil Justice Center. She holds a B.S. in Biological Sciences, summa cum laude, from Arizona State University, where she conducted research on typhoid, HIV, and malaria at the Biodesign Institute. She is a published author and contributor to the American Bar Association’s annual review of intellectual property law developments.

Nyja came to the law as a first-generation attorney, building a career on grit, transparency, and a commitment to making the law accessible, particularly for those who have historically been left out of the conversation. She approaches every matter with the understanding that the stakes are real and the outcome matters, and dedicates her practice to providing practical, people-first legal solutions.

Representation Highlights

Patent infringement & trade secret defense, medical devices — Represented a medical device company in a patent infringement and trade secret misappropriation action against a globally recognized technology company.

Favorable settlement, trademark enforcement — Represented a personal care brand in an enforcement action, successfully negotiating a settlement that limited a competitor’s rights to use a confusingly similar trademark.

Trademark registrations, USPTO prosecution — Prosecuted multiple trademark applications through to issued registrations, regularly overcoming initial refusals issued by the USPTO.

Declaratory judgment complaint, Paragraph IV ANDA — Represented a generic pharmaceutical company in preparing a declaratory judgment complaint of non-infringement in a Paragraph IV ANDA case.

Employment defense & plaintiff representation, Title VII and Labor Code — Represented employers and employees in state and federal courts on claims and defenses arising under Title VII and the Labor Code.

Pro bono victory, immigration — Successfully represented a pro bono client in securing an extension of her temporary protected status and a pending asylum application.
