Jason Tkaczuk is a business and commercial litigator who represents clients across a broad range of disputes, including complex business litigation, employment matters, intellectual property claims, and consumer class action disputes. He joined Brown Wegner LLP after building early experience in creditor’s rights litigation, business formation, and estate planning, and was named Partner in recognition of the caliber and consistency of his contributions to the firm. He is admitted to practice in California and Maryland, and handles matters in state and federal courts.

Jason earned his J.D. and M.B.A. simultaneously through the dual-degree program at UC Irvine, completing both in four years. At the Merage School of Business, he was named a Dean’s Scholar, placing in the top 12% of his class, and was inducted into Beta Gamma Sigma, the international business honor society. At the School of Law, he received the International Human Rights Seminar Dean’s Award, finished second in his class in that seminar, earned Pro Bono Honors for 120 hours of service, and was awarded a Dean’s Merit Scholarship. His research and writing distinguished him early: in law school, he was selected as a Lawyering Skills Research Fellow, working directly with faculty to train first-year students in legal research and writing. Before UC Irvine, he earned his B.A. in Political Science from UC Berkeley.

Jason’s MBA shapes how he approaches every client matter. Where many litigators focus on legal exposure in isolation, Jason brings a business lens to dispute strategy from the outset, analyzing the commercial stakes and long-term implications alongside the legal ones. His training allows him to ask the questions his clients’ executives are asking and to develop litigation strategies that account for both. Outside his practice, Jason is an active member of the Federal Bar Association, the Orange County Bar Association’s Young Lawyers Division, and the Lavender Bar Association.

Representation Highlights

Complete defense, false advertising and unfair competition, federal court — Represented a personalized matchmaking service against false advertising, unfair competition, and misrepresentation claims in federal court. Defeated class certification and obtained summary judgment on all claims, resulting in no payment to the opposing party.

Favorable settlement, pre-litigation nonprofit dispute — Resolved a complex dispute between two nonprofit organizations before litigation commenced, preserving both parties’ resources for their clients and missions.

Defeated summary judgment, breach of contract — Represented the buyer in a dispute over voter pay-per-service agreements involving a liquidated damages clause. Defeated the plaintiff’s motion for summary judgment through targeted deposition strategy that undermined the damages theory and preserved the client’s defenses.

Favorable settlement, dental lab acquisition dispute — Represented a dental laboratory in a dispute arising from a failed earn-out agreement following the sale of the business. Secured a favorable resolution within one month against a significantly larger international firm.

Substantial concessions, trademark infringement — Represented a client in a trademark infringement dispute through survey evidence. Negotiated a settlement requiring the opposing party to rebrand, including changes to its name, logo, and trademark portfolio.
